Terms of Use

These terms cover the CHOMP game and this website. They are written to be read, not to be survived. The provider is Anton Schulze, Germany — full contact details are in the Impressum.

1. What you get

CHOMP is a single-player arcade game. We give you a personal, non-exclusive, non-transferable right to install and play it on Apple devices you own or control, for as long as these terms are kept. You do not buy the game or any part of it; you get permission to use it. There is no account and no sign-up: installing the app is all it takes.

2. Apple's part in this

The app is distributed only through the Apple App Store, and your contract for the download and for every in-app purchase is with Apple, not with us. Two consequences worth spelling out:

Your use of the app is also subject to the App Store terms and to Apple's rules for Game Center and iCloud, and to Apple's Standard End User License Agreement to the extent the licence to the app itself is concerned.

3. Who may play

You need to be at least 13 years old. If you are a minor under the law of your country, you may only use CHOMP with the consent of a parent or guardian, and that parent or guardian accepts these terms with you. Purchases made by minors need their permission.

4. Purchases, coins and skins

Coins, skins, boosts, chests and every other item in the game are content we licence to you inside the game. They are not your property, they carry no cash value, they cannot be sold, transferred or exchanged outside the game, and there is no right to have any particular item remain available.

Paid items are sold by Apple through the App Store. Prices are shown before you confirm, and payment runs through your Apple Account. Because the seller is Apple, refunds are handled by Apple — through reportaproblem.apple.com, under Apple's terms. If a purchase was charged but never arrived in the game, write to us and we will fix it in the game or help you with Apple.

Restoring purchases is free and works through your Apple Account from the game's shop.

The game's settings contain a Reset everything button that erases your progress on this device and in your iCloud account. If you use it, the two paid packs can be brought back afterwards with Restore Purchases, because they are permanent unlocks tied to your Apple Account. Coins and emeralds cannot — including any that came with a pack. They are consumable items, and once they are gone they are gone. The button warns you and asks you to confirm before it does anything.

5. Rewarded ads

CHOMP shows optional rewarded ads: you choose to watch one in exchange for a revive, doubled coins, a chest or a daily gift. The reward is granted when the ad finishes. If you close an ad early or lose connection partway through, the ad network does not report a completed view and no reward is granted. What ads mean for your data is described in the Privacy Policy.

6. Leaderboards and fair play

Scores are submitted to Apple's Game Center leaderboards under the alias you chose there. Weekly boards reset every Monday at 00:00 UTC.

Scores that were not played honestly — produced with modified builds, memory editors, automation, or by exploiting a bug — may be removed from the leaderboards, and we may block further submissions from that alias. Where a score sits on Apple's servers, removal is subject to what Apple's tools allow.

7. Your save data

Progress is stored on your device and, if you have iCloud enabled, in your private iCloud container. We have no copy of it and cannot restore it for you. Deleting the app deletes the local save. Keep iCloud on if you want your progress to survive a lost phone.

8. What you may not do

Finding a bug and telling us about it is welcome and is never a breach of these terms.

9. Changes to the game, and its end

CHOMP is a live product: levels, balance, prices and features change, and parts of it may be removed. We may also stop operating the service altogether. If we shut the game down, we will announce it in the app or on this website at least 30 days in advance, and we will stop selling items that could no longer be used.

We do not promise that the game is available without interruption. Apple's services, ad networks and your own connection are outside our control.

10. Liability

We are fully liable for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent we have given a guarantee.

For simple negligence we are liable only where we breach an obligation whose fulfilment makes proper performance of these terms possible in the first place and on whose observance you may regularly rely. In that case our liability is limited to the foreseeable damage typical for this kind of agreement. Any further liability is excluded.

This game is entertainment. It is not a fitness, medical or safety product, and nothing in it should be relied on as advice.

11. Changes to these terms

We may change these terms when the game or the law changes. If a change materially affects you, we will point it out in the app or on this website before it takes effect. Changes never apply retroactively to items you have already bought. If you do not accept a change, stop using the game and delete the app; that is the whole exit, since there is no account to close.

12. Export and sanctions

By using CHOMP you confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. This confirmation is required by Apple for apps distributed through the App Store.

13. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer, this choice of law does not take away the protection given to you by the mandatory consumer law of the country you live in. Wherever you play — and CHOMP is offered worldwide — the consumer rights of your own country continue to apply to you alongside these terms.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

14. If a clause fails

If any part of these terms turns out to be invalid, the rest stays in force. The invalid part is replaced by the statutory rule that comes closest to what it was meant to achieve.
